TLDRThomas Bready is documented as being one of 20 stonemasons brought out from Ireland to work on the sandstone house Mulgoa, Fernhill for second generation colonist Edward Cox and family. Part of famous NSW estate set up by colonist Lt William Cox. House is now heritage recognised as part of Australian national trust.

Edward Cox is the youngest son b1805 of Lt William Cox a major colonist. Basically second generation of prominent settlers.-marries Jane, they live in a cottage on the block of land at Fernhill that Mulgoa is built on, then in 1839 they relocate their young family to their large stone house all quarried out of Fernhill.-date carved in stone above the front door is 1842-Mrs Jane Cox writes a memoir where she says that Edward Cox brought twenty stonemasons from Ireland to build the house (p242)
This sounds highly extravagant until one finds that they were in fact ‘bounty’ immigrants. To overcome the labour shortage, particularly in the country, the ‘bounty’ system of immigration was introduced by Governor Bourke in 1835. It was subsequently modified, by, in effect, immigrants chosen by individual colonists had the cost of their passage out subsidized by the government. In return, of course, the immigrant was expected to work for his sponsor for a given period and the usual wage. Immigrants brought out entirely by the government were often ill-chosen and between the time of their arrival and their finding work had to be maintained at government expense. Edward Cox is listed in 1837 as one of those ‘Persons to whom Authority has been granted for the importation’ of immigrants, but only two of those whom he brought out have been identified: Thomas Brady and his wife, Bridget; Michael Meally and his wife, Mary. Both men came from County Clare and both were the sons of stonemasons. They arrived by the Abbotsford in October 1839, and although not all the details of bounty immigrants are available, it seems probable that Edward Cox’s twenty stonemasons came out under this scheme.” -p242

-On Thomas Bready’s full certified death certificate Henry is listed as dead at seven years of age meaning he died in 1855 the same year as his father. Most likely after. He is listed on Thomas Bready Snr’s gravestone and in same burial plot.
further questions/ notesGoing back to the probate notes, it’s interesting to note the places the solicitor was checking for baptism records etc. there was no death cert for Henry Edward at the time. (was one issued after the fact)

Aug 20th Attending all the Roman Catholic Cathedral of St Patrcks at Melbourne and afterwards at the Church of St Ignatious at Richmond making search for any register of the death of Henry Brady whom I found and was informed that no regular read(?)registery? answering to that by the Church of England had ever been kept by the Roman Catholics.

It appeared that the defendant was engaged in carting a quantity of hay and corn to Mr. Marsh’s residence at Cook’s River, and that whilst so engaged he got drunk and permitted a truss, valued at 17s. to be wholly destroyed by stray cattle. The Bench made an order for the payment of this amount, in default to be imprisoned for seven days.

From the evidence it appeared that Thomas Bready, the deceased, lived in a tent at Myers’ flat, near Sandhurst in the year 1855. He had three children by his wife, the son at that time about 18 years of age, and two daughters, the eldest the present applicant . The eldest girl was 11 years of age, the youngest nine. Bready died on the 27th September, 1855. In the December following a will purporting to be made by him was registered in the Registrar General’s office This will left his property, a house in Webb street Fitzroy, to his wife for life, after her death his children were to have equal shares. This will was never proved, but Mrs Bready remained in possession of the rent and profits of the house. She died in April last, and it being then discovered that the will had not been proved, and as the son contested the validity of the document, this application was made. Mrs. Cooke asserted that the will was made on 3rd September, that it was written by one Daniel Gill, a sort of retired doctor, was witnessed by him and one Michael Walsh. Gill died some years ago in the Benevolent Asylum, and Walsh cannot be found. The defendant asserts that the will is a forgery, that it could not have been made without his knowledge, and that even if it was made his father was so insane from drink that he at that time did not understand what he was doing. In fact, the certificate of death said that Bready died of delirium tremens.His HONOUR reserved judgment. The Court adjourned.

in full here:The hearing of a suit was commenced the Supreme Court yesterday, before Mr. Justice Molesworth and a special jury of four, relative to the proof of a will of one Thomas Bready. Bready was a storekeeper, living at Myers flat, near Sandhurst, and he died in September, 1855. By the will sought to be proved which was dated three weeks before his death, he left his property to his wife for life, after her death to be equally divided between his children, a son and two daughters. The widow died a short time ago without having proved the will. Family differences appear to have occurred, and the son, who would be entitled as heir-at-law to all the landed property (which is situate in Collingwood, and worth about £400) disputes the validity of the will. He objects to it on two grounds-first, that it was not properly attested, and secondly, that his father when he made it was not sane. The suit was before Mr. Justice Molesworth in December last, but as the evidence was very contradictory, his Honour decided to send the case to a jury. The case was not concluded when the Court adjourned till this morning.

This will was not proved by the widow who, however, received the rents and profits from the house during her life. She died in April, 1874. The son who, if the will was invalid, would be entitled to the property as heir-at-law, now declared that the will was a forgery, and that it could not have been made at the time stated, as he was in the house nearly all day, except when he went for medicines. Besides that, his father was so insane from drink that he was incapable of knowing what he was doing. The jury, after a few minutes’ deliberation, returned a verdict in favour of the validity of the will. The Court then adjourned till Monday.
discrepancies-that Thomas Bready Jnr was born in 1837 since he was 18 in 1855
thus would have been born in 1837 meaning he would have been born back in Ireland before the wedding and come out as a baby AGED two. not the case according to passenger records. Possible though that it was in Thomas Jnr’s interest to increase his age?

in full here:THE COURTS. SUPREME COURT. In the Supreme Court on Saturday, before Mr. Justice Molesworth and a jury of four, the trial as to the validity of the will of Thomas Bready was concluded. Bready, who died in 1855, left a widow with three children, a son and two daughters. The will sought to be proved devised the property, a house in Collingwood, to the widow for life, after her death the children to have equal shares in it. Mrs. Bready having died lately, the two daughters sought to prove the will, for which, although registered, no probate had been taken out. This application was resisted by the son, on the ground that his father never made the will, and, if he did, that he was so insane that he did not know what he was doing. The jury found in favour of the validity, of the will.
